Pier Advantage Terms & Conditions

Payment Terms - Pre-Payment Required: All Membership fees are payable in advance. Members choosing the monthly option must pay their fee before the start of each service month. Members choosing the annual option must pay the full discounted amount upfront. No Refunds (Monthly): Monthly membership fees are non-refundable once paid, regardless of the Member's use of the services. Service Suspension: PSC Marine reserves the right to immediately suspend all services and priority scheduling if the Membership fee is not paid when due.

Membership Term and Cancellation Policy (New Section) - Monthly Membership Cancellation (Member): Members may cancel their monthly membership by providing written notice at least thirty (30) days prior to the next billing date. The membership will remain active until the end of that thirty-day period, and no partial refunds will be issued for any unused portion of the pre-paid term. Annual Membership Cancellation (Member): Annual memberships are non-cancellable and non-refundable. The Member may provide written notice of non-renewal, which must be received at least thirty (30) days prior to the annual renewal date. Failure to provide timely notice will result in automatic renewal and billing for the following year. Cancellation by PSC Marine: PSC Marine reserves the right to cancel or terminate any membership at any time, for any reason or no reason, upon providing the Member written notice. In the event PSC Marine cancels a monthly membership, a prorated refund for the unused days of the current month may be issued. If PSC Marine cancels an annual membership, the Member will receive a prorated refund for the remaining full months of the annual term.

Disclaimer of Warranties and Limitation of Liability - Disclaimer: EXCEPT FOR THE LIMITED WARRANTY ON WORKMANSHIP PROVIDED HEREIN, PSC MARINE EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (SEAWORTHINESS). Catastrophic Loss: PSC Marine is not liable for the loss, sinking, total destruction, or major damage to the Vessel or its contents from any cause, including, but not limited to, fire, weather, natural disaster, theft, or vandalism. The Member retains all responsibility and risk of loss for the Vessel. Inspection Disclaimer: The Monthly Visual Inspections (Exterior and Interior) are non-invasive, limited visual checks designed only to look for obvious issues. PSC Marine is not responsible or liable for any damage, loss, or expense arising from or related to any condition, defect, or deficiency that was present but not detected or noted during any inspection. Limitation of Consequential Damages: PSC MARINE, ITS EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE IN CONTRACT, TORT, OR OTHERWISE FOR ANY LOSS OF USE, LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, REGARDLESS OF THE CAUSE. Maximum Liability: PSC Marine’s maximum liability for any claim shall be strictly limited to the COST OF REPAIR OR REPLACEMENT of the defective work or, at PSC Marine's sole option, the total amount paid by the Member for the specific service from which the claim arose.

Member Responsibilities and Insurance Requirements - Vessel Condition: The Member warrants that the Vessel is in safe and seaworthy condition and that the Member is solely responsible for its condition, maintenance, and operation at all times. Required Insurance: The Member must maintain full marine hull and machinery insurance and marine liability insurance with limits of at least $300,000 per occurrence. Waiver of Subrogation: The Member, for themselves and their insurers, agrees to waive all rights of subrogation against PSC Marine, its agents, and employees for any loss or damage to the Vessel, its equipment, or contents.

Indemnification and Hold Harmless  - Indemnification: The Member agrees to defend, indemnify, and hold harmless PSC Marine, its agents, and employees from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to the membership, the performance of services, or the presence of the Vessel at any location, except to the extent caused by the sole gross negligence or willful misconduct of PSC Marine.

Service Provisions and Non-Bailment - Vessel Access: The Member grants PSC Marine safe and unrestricted access to the Vessel at all times to perform the services. No Bailment Created: The parties agree that this is a service contract, and no bailment is created. The Member retains access to the Vessel at all times. Concealed Defects: PSC Marine is not responsible for damage caused by concealed or latent defects in the Vessel.

Governing Law and Dispute Resolution - Governing Law: This Agreement shall be governed by the maritime law of the United States and, to the extent not inconsistent, the laws of the State of Washington.
